BOMA/Chicago Begins Negotiations with Local 399 on Building Engineers Contract

BOMA/Chicago's Labor Committee has begun negotiations with Local 399 on the new contract. Building Members are encouraged to complete the new signatory forms. The existing Building Engineers contract with IUOE Local 399 was previously extended through September 14.

SEIU Health and Welfare Benefits Extended through August 31, 2020

The Trustees of the Participating Employers Health Trust voted to extend health and welfare benefits to employees who were laid off as a result of the pandemic through August 31, 2020. The additional coverage will not result in any additional cost to or contribution from the Employer.

BOMA/Chicago Contract with IUOE Local 399 Extended through September

As we continue to respond to the impact of COVID-19 and due to our inability to gather to negotiate, we have reached an agreement with the International Union of Operating Engineers Local 399 to extend the existing contract for building engineers through September 14, 2020.

New Memorandum of Agreement with SEIU Local 1 for Janitorial and Security Contracts

On March 27, 2020, BOMA/Chicago's Board of Directors ratified a Memorandum of Agreement (MOA) with SEIU Local 1 which was effective as of March 26, 2020. A link to the MOA can be accessed at the bottom of this page if you are a member and are logged into the site.

Please review carefully the MOA, which provides Employers with much-needed flexibility to adjust the number, scope, schedule, and hours of the security and cleaning workforce as building conditions are and continue to change in light of the COVID-19 pandemic.

  • If a reduction in force is necessary due to a change in scope, Employers need not provide the required 10-day advance notice.
  • Employers have the flexibility to change assignments, change schedules, and change the number of hours worked per week in response to impact of the COVID-19 pandemic. Employers should continue to provide as much notice as possible to the impacted employees and also notify the union. (These provisions are addressed in paragraphs 4 and 5.)
  • The MOA provides that employees who are directed by their Employer to remain off work due to a workplace exposure to COVID-19 will receive up to two weeks of paid time off at their regularly scheduled rate.
  • Employees will be allowed to use their accrued PTO, if available, in the event of personal decisions by an employee to self-quarantine due to COVID-19.
  • The MOA also states that BOMA/Chicago and the Union will recommend that employees who are laid off as a result of the pandemic be able to continue their health insurance from the SEIU Local 1 and Participating Employers Health Trust for an additional thirty days from the date of their layoff or loss of eligibility. The Trustees of the Health Trust retain authority to make this change, and the MOA provides that such an additional coverage will not result in any additional cost to or contribution from the Employer. (These provisions are addressed in paragraphs 1 – 3.) The Trustees of the Health Trust approved that recommendation today.

The MOA expires on April 26, 2020.

How Health Insurance Extension Under the MOA Will Work

The original contracts with SEIU Local 1 provide for health insurance coverage for the entire month in which the layoff occurs. Under the MOA, anyone laid off as a consequence of COVID-19 impact would receive an additional 30 day extension of health insurance. The MOA provides that such an additional coverage will not result in any additional cost to or contribution from the Employer.
Here are some examples of how this would work:

  • Layoff effective today through March 31 => Under original contract, Health Insurance would end March 31. Under MOA, Health Insurance will be extended through April 30
  • Layoff effective April 1 through April 30 => Under original contract, Health Insurance would end April 30. Under MOA, Health Insurance will be extended through May 31

Tolling Agreement Postponing Grievances and Arbitrations for a Period of 30 Days

BOMA/Chicago and the union also agreed to a related Tolling Agreement providing that for a period of 30 days the parties will essentially postpone grievances, arbitrations, and any other applicable statutes of limitations, with respect to grievances under the MOA or the existing collective bargaining agreements.

Labor Contract Guidance for Signatory Buildings

Recap of Federal Economic Relief in Response to Coronavirus

On Wednesday, March 18, 2020, the Senate passed the Families First Coronavirus Response Act, and President Trump signed the bill into law.

BOMA/Chicago’s labor law firm, Cozen O'Connor, provided a recap of some of the major provisions of the law which includes modifications to FMLA, paid sick leave, health care, tax credits and unemployment. Next the White House and Congress will focus on a third larger piece of COVID-19 legislation to provide additional economic relief.
