Victory for Building Data Access: HB3312 Passes in Veto Session
BOMA/Chicago, in partnership with the Illinois Green Alliance, successfully advocated for the Utility Data Access Act (HB3312), which was passed as part of the comprehensive Energy Omnibus Bill during the Illinois General Assembly’s Veto Session. This legislation requires utilities to provide whole-building energy data to properties subject to benchmarking requirements—an essential step toward increased transparency and energy efficiency.
With the Governor expected to sign the bill into law, the next phase is rulemaking. The Illinois Commerce Commission (ICC) is now tasked with initiating a formal rulemaking process within 90 days of enactment. The ICC will have up to two years to finalize the rules governing how utilities provide access to aggregated energy data. BOMA/Chicago will remain actively engaged throughout this process to ensure the rules are practical, equitable, and aligned with the needs of commercial building owners and managers.
